Terms and Conditions

1. Scope and seller

These Terms and Conditions apply to all orders placed through the online shop at maviene.com. Your contractual partner is:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. Deviating terms of customers do not apply unless I expressly agree to them.

2. Conclusion of the contract

The presentation of products in the shop is not a legally binding offer but an invitation to place an order.

How ordering works: you add products to the cart and go to checkout. There you enter your contact and delivery details, choose shipping and payment method and see all details including the total price once more before submitting. Until then you can correct your entries at any time using the usual keyboard and mouse functions or cancel the process. By clicking the button "Pay now" (or a correspondingly labelled button depending on the payment method, e.g. PayPal or Klarna) you submit a binding offer to purchase the goods in your cart.

The purchase contract is concluded when I accept your order by sending an order confirmation by email. You usually receive this email right after submitting your order.

3. Contract language and storage of the contract text

The contract languages are German and English. I store the contract text. I send you the order details and these Terms with the order confirmation by email. You can also view these Terms in the shop at any time. If you have created a customer account, you can also find your orders there.

4. Prices and shipping costs

All prices in the shop are final prices. As a small business within the meaning of Section 19 of the German VAT Act (UStG), I do not charge VAT and therefore do not show it.

Shipping costs may apply in addition to the product price. Current shipping costs can be found in the shipping information and in the checkout before you submit your order.

5. Delivery

I ship to Germany, Switzerland, the USA and Canada. Orders are usually packed and shipped from Germany within 2 to 5 business days. Delivery times after shipping can be found in the shipping information.

For deliveries to Switzerland, the USA and Canada, customs duties, import taxes or fees may be charged in the destination country. These are not included in the price and are paid by the recipient.

If, contrary to what was shown in the shop, a product is not available after you ordered it, I will inform you immediately and refund any payments already made without delay.

6. Payment

You can use the payment methods shown in the checkout, currently for example PayPal, Klarna, Apple Pay and credit card. Depending on the payment method, payment is due when the order is completed or at the time specified by the payment provider. Klarna's terms additionally apply to payments with Klarna.

7. Retention of title

The goods remain my property until paid in full.

8. Right of withdrawal

As a consumer you have a statutory right of withdrawal. Details can be found in the withdrawal policy. You can also withdraw directly online via the button "Withdraw contract".

9. Warranty

Statutory warranty rights apply. The warranty period for new goods is two years from delivery.

If goods arrive with visible transport damage, please report the damage to the delivery driver if possible and let me know briefly at info@maviene.com. This helps me assert claims against the carrier. Your statutory rights remain unaffected even if you do not do so.

10. Liability

I am liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), my liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

11. Gift cards

Gift cards are delivered by email. They can be redeemed in the shop for products but not for the purchase of further gift cards. Cash payment is not possible. Any remaining balance is retained. Gift cards are valid for at least three years from the end of the year in which they were purchased.

12. Discount codes

Discount codes are only valid during the stated period and under the stated conditions; one code can be redeemed per order. Cash payment is not possible.

13. Free digital downloads

Free downloads (e.g. desktop wallpapers) are sent to you by email after completing the free order. You may use them for private purposes. Sharing, selling or commercial use is not permitted.

14. Dispute resolution

I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If something is not right, just write to me at info@maviene.com and I will be happy to find a solution.

15. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.

Should any provision of these Terms be invalid, the remaining provisions shall remain valid.
